Court fixes date to rule on marriage between grandfather, granddaughter

The Higher Shari’a court sitting in Tsafe Local Government Area of Zamfara State has fixed the 2nd of August 2022 for ruling in a case filed against one Musa Tsafe who married his granddaughter.

The presiding judge of the court, Bashir Mahe said he has heard the augments from both the plaintiff and the defendants and will deliver his judgement on Tuesday 2nd August 2022.

Fielding questions from journalists immediately after the session, the Counsel to the defendants, Ayuba Abdulahi said he collected some documents from the court last week and that when he studied the documents, the Islamic conditions for the dissolution of marriage were not followed.

According to him, the Hisba commission did not follow the laid down conditions before rushing to the Higher Shari’a court to dissolve the marriage.

Abdullahi explained that he has no confidence in the Higher Shari’a court, saying that he was praying for a court to transfer the case to the Upper Shari’a court.

“If the Higher court rules against the defendants on the 2nd of August 2022, we must appeal the case at the Shari’a court of competent jurisdiction”

However, Newsmen gathered that the relations of the couples in 2020 realized that marriage WS illegal and did not follow the principles of Islam, saying that both the husband and the wife are blood relations and were not supposed to be married.
