An Abuja Federal High Court has adjourned a suit seeking the removal of the Director General of the Bureau of Public Procurement (BPP), Mr Mamman Ahmadu.
In the suit numbered FHC/ABJ/CS/1056/2023, the Network for the Actualisation of Social Growth and Viable Development (NEFGAD) is challenging the appointment of the Director General of the BPP on the grounds that it did not follow laid-down rules.
The presiding judge, Justice Gladys K. Olotu, after listening to arguments on Thursday, adjourned the matter to July 24, 2024, for the adoption of motions.
NEFGAD in the suit had argued that the appointment of Ahmadu as BPP Director General by former President Muhammadu Buhari was in contravention of the Public Procurement Act, 2007.
The civil society organization specifically argued that the appointment contravened Section 7(1) of the Act.
The organization prayed the court to declare the appointment illegal and subsequently order Ahmadu to refund all the salary and other emoluments received by him since the day of his appointment to date.
Joined in the suit as respondents, alongside BPP, are President Bola Tinubu and the Attorney General of the Federation and Minister of Justice, Lateef Fagbemi.
NEFGAD was represented in court by its lead counsel, Barrister Timilehin Odunwo of Emporium Law Chambers, while the Head of Civil Litigation in the Office of the Attorney General of the Federation, Mrs. Maimuna Shitu, represented the respondents.
