Breaking: Court revokes ex-Abia Gov. Orji Kalu’s bail

Court has revoked the bail granted ex-Abia State Governor, Orji Uzor Kalu, for failure to appear, the News Agency of Nigeria reports.

The PUNCH reported that hearing in the trial of Kalu for an alleged fraud of N7.65bn was stalled last Monday due to the absence of the ex-governor from court.

Kalu’s lawyer, Prof. Awa Kalu (SAN), told Justice Mohammed Idris at the Federal High Court in Lagos that his client was away in Germany for a surgical operation.

He added that the ex-governor had been advised by his doctors to remain in Germany for some time to recuperate.

The defence counsel said counsel for the Economic and Financial Crimes Commission, Mr Rotimi Jacobs (SAN), was aware of the development and urged Justice Idris to further adjourn the case.

But the EFCC prosecutor, Jacobs, said he was surprised at Kalu’s absence from court, adding that he did not know if or when the ex-governor obtained the court’s permission to travel out.

Jacobs noted that having submitted his passport to the court as part of his bail conditions, Kalu must always apply to the court for the passport whenever he wished to travel.

Describing the ex-governor’s absence from court as an attempt to frustrate the case, Jacobs urged Justice Idris to interpret Kalu’s absence to mean that he had jumped bail.

“I am not aware when the 1st defendant wanted to travel. We only got to know that the 1st defendant travelled abroad for medical treatment through his media aide, one Kunle Oyewunmi.

“Things must be done in accordance with the law. In my own view, what happened is that the 1st defendant has jumped bail. This is an attempt to further frustrate this trial because no application was made to the court to travel.

“I urge Your Lordship to treat the absence of the 1st defendant as that he has jumped bail,” Jacobs said.

Responding, however, the defence counsel urged Justice Idris to discountenance Jacob’s argument, saying as of when Kalu travelled out, the court had adjourned the case sine die (indefinitely).

Ruling on the lawyers’ submissions, Justice Idris noted that it was true that the matter was adjourned sine die on September 27, 2018 but Kalu was on November 2 served with a hearing notice that the case had been scheduled for Monday.

The judge also noted that the court received a mail confirming Kalu’s treatment arrangement, but he said the defence counsel failed to attach any medical report to guide the court as to Kalu’s post-surgery treatment.

Justice Idris said in the circumstance, he would, in the interest of justice, adjourn the case for the last time, stressing that Kalu must return from Germany within seven days and appear before the court.

The judge ruled, “I have always stated that every citizen of this country is entitled to and has the right to seek medical treatment abroad. This right is guaranteed by the constitution, the African Charter on Human and Peoples Rights, the International Covenant of Civil and Political Rights and the Universal Declaration of Human Rights. It is an inalienable right.

“However, this right has exceptions; therefore, in exercising this right due regard must be had for the law and due process.

“Apart from the mail confirming the treatment arrangement of the 1st defendant, the defence counsel should have obtained a medical report on the condition of the 1st defendant post-surgery. This would have properly guided the court in the proceedings of today.

“However, in the light of the entirety of this case and in the interest of justice, I am prepared to grant to the 1st defendant a final adjournment in respect of this matter.

“In the light of the provisions of the ACJA, I shall not adjourn for more than seven days from today. It is, therefore, hereby directed that the 1st defendant shall return to the country within seven days from today’s date for the hearing of this matter.”

The matter was adjourned till Monday, November 12, 2018 for continuation of trial; but as Kalu failed to appear, his bail was revoked.

The presidential candidate of the Peoples Democratic Party (PDP), Atiku Abubakar, has said the assassination of former Chief of Defence Staff, Alex Badeh should be blamed on rising insecurity in the country.

Badeh, a four-star General of the Nigerian Air Force (NAF), was shot dead on Tuesday along Abuja-Keffi Road.

Atiku, in a statement issued on Wednesday by his Special Assistant on Public Communication, Phrank Shaibu, said had gunmen not waylaid the vehicle in which Alex Badeh was travelling, he would not have sustained the gunshots and the health complications that terminated his life.

Abubakar said while Badeh’s death made headline news because of the personality involved, many ordinary Nigerians are either killed or maimed on a daily basis by rampaging armed robbers, kidnappers, herdsmen and hoodlums across the country.

The former vice president noted that the best tribute that President Muhammadu Buhari can pay to the late security chief is to ensure free and fair polls next year and return home to a well-deserved rest.

The statement read: “We cannot continue to pretend that all is well with the security system in our country, where armed robbers seem to be having a field day.

“It is, therefore, time to look at credible options, especially electing a more prepared candidate who will ensure that policemen and women are well equipped and motivated. Fortunately, the People’s Democratic Party (PDP) had shown what can be achieved when the police are provided with adequate resources and are well motivated.

“It is no longer news that during the 16 years when the PDP was in power, the nation boasted of the better motivated, best equipped and best-mobilized policemen in the country.

“We are shocked and saddened by the circumstances of the death Mr Badeh, an air chief marshal, whom was a fine officer, among the best of his time, one who never lost touch with officers and men despite holding several top positions in the nation’s military establishment.”

Abubakar further prayed that God will grant repose to Badeh’s soul and comfort those he left behind.

The Senator from Kaduna Central, Shehu Sani has reacted to the death of Former Chief of Defence Staff, Alex Sabundu Badeh.
DAILY POST had reported that Badeh who rose to the rank of Air Chief Marshal in the Nigerian military, died from gunshot wounds he sustained after his vehicle was attacked while returning from his farm along Abuja-Keffi Road on Tuesday.

In a reaction, Shehu Sani on his Twitter Page said if such tragic death could befall Badeh, then it can happen to anyone.

He said, “Alex Badeh;It’s sad and tragic. If it can happen to Alex, it can happen to anyone.

“May his soul Rest In Peace. My condolences to his family.”

The National Association of Nigerian Students (NANS), on Wednesday condemned the killing of the immediate past Air Chief Marshal, Alex Badeh, retired Chief of Defence Staff.

Badeh, a four-star General of the Nigerian Air Force (NAF), was shot dead on Tuesday along Abuja-Keffi Road.

The Director of Public Relations and Information, NAF, Air Commodore Ibikunle Daramola, confirmed Badeh’s assassination in a statement in Abuja on Tuesday.

He said that that the former defence chief died from gunshot injuries sustained when his vehicle was attacked on Abuja-Keffi Road while returning from his farm.

Badeh was 18th Chief of Air Staff from Oct. 4, 2012 to Jan. 16, 2014; and the 15th Chief of Defence Staff from Jan. 16, 2014 to July 13, 2015.

NANS National Public Relations Officer, Mr Bestman Okereafor, in a statement in Enugu, urged security agents to ensure that the perpetrators of “this evil are brought to book without delay.“

“The attention of the apex students governing body, NANS, has been drawn to the gruesome assassination of Air Chief Marshal Alex Badeh, a retired four-star flag officer of the Nigerian Air Force (NAF).

“NANS, in all totality, condemns the killing and considers this as very unfortunate, disheartening and one that has no doubt once again portrays our beloved country in a negative way and manner in the commity of nations.

“If a former Chief of Defence Staff can be assassinated in such a manner in a democratic rule, what then is the fate of common defenceless Nigerians?

“NANS is calling on security agents across the country to step up security measures as the Yuletide draws nearer, and specifically ahead of the 2019 General Elections,’’ he said.

He said the association was not unaware of the Federal Government’s efforts to tackle insecurity in the country even though it was being frustrated by some political gladiators.

“On this sad note, NANS is bidding the former Chief of Defence Staff farewell.

“May God grant the Badeh family, government of Adamawa and the Nigerian Air Force the fortitude to bear this irreparable loss, we pray that his gentle and rugged soul rest in peace, Amen.’’
